Terms of Service

1. Scope and Acceptance

These Terms of Service ("Terms") govern your use of clubstream.io ("the Platform", "we", "us"), operated by Alexander Sadomsky. By accessing, registering, or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform. These Terms apply to all users, including visitors, registered users, DJs, and listeners.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and clubstream.io regarding the use of the Platform.

2. Description of Service

clubstream.io is a platform for discovering live electronic music streams. The Platform provides:

• A directory of DJs and their live streams (via Twitch integration)
• DJ and listener profile creation
• Genre-based browsing and discovery
• Follow functionality for DJs
• Embedded Twitch stream viewing
• Vibr — An algorithmic tool for harmonic mixing analysis, key detection, and energy flow optimization (currently in development)
• Selected Requests — An upcoming feature allowing listeners to request songs from a DJ's curated tracklist during a live stream, with optional listener contributions (currently in development)

The Platform does not host or control stream content. All streams are provided by third-party broadcasters via Twitch. Features marked as "in development" or "coming soon" are announced for informational purposes only and do not constitute a binding promise of delivery, timeline, or specific functionality.

3. Registration and Account

3.1 Authentication

Registration is exclusively via Twitch OAuth 2.0. By signing in, you authorize us to receive and store certain data from your Twitch account as described in our Privacy Policy.

3.2 Eligibility

You must be at least 16 years old to use the Platform. If you are under the age required in your jurisdiction, you may only use the Platform with verifiable parental or guardian consent. By registering, you confirm that you meet this age requirement and that all information you provide is accurate.

3.3 Account Responsibility

You are responsible for all activity that occurs under your account. You must not share your account credentials or allow third parties to access your account. Notify us immediately if you suspect unauthorized use.

3.4 Account & Profile Deletion

You may delete your profile or your entire account at any time directly from your Dashboard:

• Delete Profile — Removes your public DJ or Listener profile while keeping your account active.
• Delete Account — Permanently removes your account and all associated data. You will be signed out immediately.

Both actions require typing "DELETE" as confirmation and are irreversible. Alternatively, you may request deletion by contacting us at [email protected]. We reserve the right to suspend or permanently delete accounts that violate these Terms.

4. User Conduct

When using the Platform, you agree not to:

• Upload or submit content that is offensive, discriminatory, harassing, defamatory, or illegal
• Impersonate any person or misrepresent your affiliation with any entity
• Infringe on third-party intellectual property rights (trademarks, copyrights, personal rights)
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Use automated tools (scrapers, bots, crawlers) without prior written permission
• Interfere with the proper functioning of the Platform
• Use the Platform for any unlawful purpose or in violation of applicable laws
• Circumvent any security or access restrictions

5. DJ Profiles and Content

5.0 Auto-Discovered Profiles

clubstream.io may automatically create temporary profile pages for Twitch streamers who are actively broadcasting in music or DJ categories. These profiles are based on publicly available Twitch data and are clearly labeled as auto-generated.

Auto-discovered profiles are not indexed by search engines and become inaccessible after a period of streamer inactivity. The affected streamer did not create, authorize, or endorse these profiles.

If you are a Twitch streamer and wish to have your auto-discovered profile removed, you may:

• Use the "Request profile removal" link on the profile page
• Contact us via our contact form (category: "Data Removal / Privacy Request")
• Email [email protected]

Removal requests are processed within 48 hours. For details on the data we process and the legal basis, see our Privacy Policy (§4.5).

5.1 Profile Content

As a registered user, you may create a DJ profile. The following rules apply:

• Your DJ name, bio, and all profile information must not contain offensive, discriminatory, or illegal content
• You must have the right to use the DJ name you register (no trademark infringement)
• Profile information must be truthful and not misleading

5.2 Stream Content

Content streamed via Twitch is subject to the Twitch Terms of Service and Twitch Community Guidelines. clubstream.io does not control or moderate stream content.

5.3 Content License

By submitting content to the Platform (bio, profile information), you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute this content in connection with the operation of the Platform. This license ends when you delete the content or your account.

5.4 Content Moderation

We reserve the right to remove, restrict, or modify any user profile, listing, stream embed, or other content that violates these Terms or applicable law, or that we reasonably consider harmful to the Platform, its users, or third parties. This includes, but is not limited to, delisting streams, removing profiles, and restricting access to specific features. We are not obligated to provide prior notice before taking such action, although we will endeavor to inform affected users where practicable.

6. Clubstream Club & Tier System

6.1 Nature of the Tier System

clubstream.io operates an informal tier system ("Listed", "Clubstream Club", "Clubstream Featured") that reflects a DJ's level of engagement with the Platform. These designations are purely informational labels within the Platform and do not constitute a legal membership, association, subscription, certification, or endorsement of any kind.

6.2 No Contractual Entitlement

Tier status does not create any contractual entitlement, legal claim, or binding obligation between you and clubstream.io. In particular:

• No tier grants a right to specific platform features, rankings, or visibility
• The "Clubstream Club" designation does not imply a membership contract or recurring obligation
• The "Clubstream Featured" designation is editorially selected at our sole discretion
• No financial benefits, compensation, or revenue-sharing is associated with any tier

6.3 Benefits and Changes

Benefits associated with tiers (such as higher ranking in listings, visual badges, or priority placement) are provided at our discretion and may be modified, reduced, expanded, or discontinued at any time without prior notice. We reserve the right to:

• Change the criteria for obtaining or maintaining any tier
• Revoke or downgrade a tier at any time, including for inactivity
• Rename, restructure, or eliminate the tier system entirely
• Add, modify, or remove benefits associated with any tier

6.4 Overlay & Verification

Promotion to the "Clubstream Club" tier requires the use of a stream overlay provided by the Platform. The overlay is a technical mechanism to confirm active participation and does not constitute a verification of identity, skill, or quality. The term "Club" is used colloquially to describe community participation and does not imply any formal club, organization, or legal entity.

6.5 No Guarantee of Visibility

While we aim to provide benefits such as improved ranking and priority placement to active Club members, we do not guarantee any specific level of visibility, traffic, viewers, or discoverability. Platform algorithms, user behavior, and external factors may affect the actual impact of any tier-related benefit.

7. Vibr (Algorithmic Mixing Tool)

7.1 Nature of the Service

Vibr is an algorithmic tool provided by clubstream.io that analyzes musical keys, BPM, energy levels, and harmonic relationships to assist DJs with set building and mixing decisions. Vibr is currently in development and available as an early-access feature for Clubstream Club members.

7.2 Data Processing

Vibr processes tracklist data that you voluntarily upload or input, including track titles, artists, keys, BPM values, and energy levels. This data is stored in association with your account and used solely to provide the Vibr functionality. You retain full ownership of your tracklist data.

7.3 No Guarantee of Accuracy

Vibr's analysis is algorithmic and provided for informational and creative assistance only. We do not guarantee the accuracy, completeness, or suitability of any harmonic or energy analysis. Musical decisions remain your responsibility as the performing DJ.

7.4 Availability

As an early-access feature, Vibr may be modified, temporarily unavailable, or discontinued at any time without prior notice. We will make reasonable efforts to inform users of material changes.

8. Selected Requests & Listener Contributions

8.1 Nature of the Feature

Selected Requests is an upcoming feature that allows listeners to browse a DJ's curated tracklist and request specific songs during a live stream. Requests are accompanied by a voluntary listener contribution ("tip") that is directed to the performing DJ. This feature is currently in development and not yet available.

8.2 Role of the Platform

clubstream.io acts as a technical intermediary facilitating the transaction between listener and DJ. We are not a party to the transaction between you and the DJ. The Platform does not guarantee that any requested song will be played. The DJ retains full creative control over their set and may decline any request at their discretion.

8.3 Contributions & Fees

Listener contributions are voluntary payments directed to the DJ. A portion of each contribution covers payment processing costs and a small platform fee. Exact pricing tiers and fee structures will be communicated transparently before the feature launches and within the feature interface. No hidden fees will be applied.

8.4 Refund Policy

Since contributions are voluntary and constitute a direct tip to the DJ (not a purchase of goods or a guarantee that a song will be played), refunds are generally not available. Exceptions may apply in cases of technical failure where the contribution was not properly transmitted. Disputes should be directed to [email protected].

8.5 DJ Responsibility

DJs who participate in Selected Requests are responsible for managing their available tracklists and for any applicable tax obligations arising from received contributions. clubstream.io does not provide tax advice and is not responsible for your tax compliance.

8.6 Feature Availability

Selected Requests is announced as an upcoming feature. All descriptions are subject to change. We reserve the right to modify pricing, functionality, availability, or to discontinue the feature entirely before or after launch. No binding commitment is made by announcing the feature.

9. Intellectual Property

The Platform, including its design, code, logos, and original content, is the property of clubstream.io and is protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the Platform without our explicit written permission.

10. Platform Availability & Changes

clubstream.io is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation. Scheduled maintenance windows will be communicated when possible.

We may change, remove, or introduce features of the Platform at any time without prior notice. This includes modifications to the user interface, available functionality, supported integrations, and content presentation. We will make reasonable efforts to inform users of material changes but are not obligated to do so.

11. No Warranty

To the maximum extent permitted by applicable law, the Platform is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, reliability, accuracy, or availability. We do not warrant that the Platform will meet your requirements, that it will be available at all times, or that it will be free of errors, viruses, or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by German law:

• clubstream.io is not liable for content transmitted via embedded Twitch streams
• We are not liable for the availability, quality, or accuracy of third-party services (Twitch, Cloudflare)
• We are not liable for damages arising from the use of the Platform, except in cases of intent or gross negligence
• We are not liable for data loss that occurs despite reasonable security measures
• Our liability for slight negligence is limited to foreseeable, contract-typical damages

These limitations do not apply to liability for injury to life, body, or health, or to mandatory statutory liability.

13. Termination & Suspension

We reserve the right to terminate, suspend, or restrict access to the Platform, in whole or in part, at our sole discretion if:

• A user violates these Terms or applicable law
• Continued access may create legal, security, or operational risks
• We receive a valid legal request from a competent authority
• We decide to discontinue the Platform or specific services

Where possible, we will provide affected users with reasonable notice and an explanation. Provisions of these Terms that by their nature should survive termination (including but not limited to Sections on Liability, Indemnification, Governing Law, the Clubstream Club & Tier System, and Selected Requests & Listener Contributions) shall remain in effect.

14. Independence from Twitch

clubstream.io is an independent platform and is not affiliated with, endorsed by, or sponsored by Twitch Interactive, Inc. or Amazon.com, Inc. Use of the Twitch API is in accordance with the Twitch Developer Agreement. All Twitch-related trademarks, service marks, and logos belong to their respective owners.

15. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.

16. Email Communications

14.1 Notification Emails

If you opt in via your notification settings, we may send you emails for the following purposes:

• Informing you when a DJ you follow starts streaming ("DJ Goes Live")
• Platform updates, new features, and maintenance notices ("System Announcements")
• Personalized DJ and stream recommendations ("Recommendations")

14.2 Opt-In / Opt-Out

All email notification types are disabled by default and require your explicit opt-in. You may disable any or all email notifications at any time via your notification settings or by using the unsubscribe link included in every email. Changes take effect immediately.

14.3 Transactional Emails

Certain emails (e.g. responses to contact form submissions) are transactional in nature and are sent regardless of your notification preferences. These emails are necessary for the operation of the service and do not constitute marketing communications.

17. Consumer Rights

If you are a consumer residing in the European Union or the European Economic Area, mandatory consumer protection laws of your country of residence may grant you additional rights that cannot be limited or waived by these Terms. Nothing in these Terms shall affect or limit those statutory rights. As clubstream.io is currently a free service, the EU right of withdrawal (Widerrufsrecht) for digital services does not apply to the Platform itself. Should features involving financial transactions (such as Selected Requests) become available, the applicable withdrawal rights, cancellation policies, and consumer information obligations will be communicated within the feature interface and in updated versions of these Terms prior to launch.

18. Indemnification

You agree to indemnify and hold harmless clubstream.io, its operator, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms or your use of the Platform.

19. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting on this page. For material changes, we will notify registered users via the Platform or email. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Platform.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The exclusive place of jurisdiction is Hamburg, Germany, to the extent legally permissible. Mandatory statutory provisions regarding the place of jurisdiction for consumers remain unaffected.
